AMENDMENT OF REGULATION OF THE DIRECTOR GENERAL OF
CUSTOMS AND EXCISE NO. 11/BC/2005 ON PRIORITY LANE

THE REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON AMANDMENT OF REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE NO. 11/BC/2005 ON PRIORITY LANE

Article I

Several provisions in Regulation of the Director General of Customs and Excise No. 11/BC/2005 on Priority Lane are amended as follows:

1. To insert one point between Article 1 point 3 and point 4 to become point 3a reading as follows:

" 3.a. Customs Settlement Service Providers (PPJK) are business entities undertaking activity to settle the fulfillment of customs liabilities for and on behalf of owners of goods."

2. To abolish Article 2 paragraph (2) letter g.

3. To insert an article between Article 2 and Article 3 to become Article 2a reading as follows:

"Article 2A

(1) Customs declarations can be submitted by:

(2) In the case of importers authorizing the submission of customs declarations to PPJK, the importers submit application on behalf of the authorized PPJK to the Director General.

(3) The Director General accepts or rejects the application as meant in paragraph (2) on the basis of profile of PPJK.

(4) PPJK already approved by the Director General are obliged to make agreement on Electronic Data Interchange with importers and the Directorate General of Customs and Excise (DJBC)."

4. To amend the provision in Article 4 paragraph (3) letter b so as to read as follows:

"b. Guarantee for the exemption from import duty and taxes in the framework of the import for IJP securing Facility of Import Relief for Export Purpose (KITE)."

5. To amend the provision in Article 8 letter a as well as supplement new provisions, namely letters d and e, so as to read as follows:

"a. not giving or rendering importer module to other parties/companies.

d. giving up power of attorney of the appointment of names of PPJK authorized to submit customs declaration in the case of importers using services of PPJK.

e. notifying change in names of authorized PPJK to the Director General attn. The Director of Customs Technical Affairs in not later than 10 working days before the revocation of power of attorney."

6. To amend the provisions in Article 9 paragraph (1) and paragraph (3) letter g so as to read as follows:

"(1) In order to obtain the facility of priority lane, importers submit application to the Director General through the Director of Customs Technical Affairs.

(3) g. Copy of certificate of customs expert owned by companies in the case of customs declaration being submitted directly by importers or power of attorney (appointment) from importers to PPJK, in the case of the submission of customs declarations being authorized to PPJK."

7. To amend the provision in Article 10 so as to read as follows:

"Article 10

(1) The Director General accepts or rejects the application as meant in Article 9 paragraph (1).

(2) The rejected application can be submitted again after importers fulfill the requirements as contained in reasons for the rejection."

8. To amend Attachment III so as to be as stipulated in Attachment I to this regulation.

9. To amend Attachment V so as to be as stipulated in Attachment II to this regulation.

10. To amend Attachment II so as to be as stipulated in Attachment III to this regulation.

Article II

The regulation of the Director General comes into force after 15 (fifteen) days as from the date of stipulation.

For public cognizance, the regulation shall be announced by publishing it in State Gazette of the Republic of Indonesia.
